一、什么是创造性?

简单来说,创造性就是判断一项发明创造是否“非显而易见”。如果对于本领域普通技术人员而言,这项发明是显而易见的,那就没有创造性。
二、案例一:按摩磨毛牙刷——组合发明的创造性判断
发明内容
这是一件名为“按摩磨毛牙刷”的专利申请。它的技术方案很简单:在刷头的正面设有多排刷毛(这是牙刷都有的),刷毛的上端面都磨成圆弧形;同时,刷头的背面是凹凸面,或者设有多个凸块。
发明人声称,这种牙刷既能清洁牙齿,又能在刷牙时按摩口腔内的穴位(如颊车、地仑),促进头部血液循环;同时,磨成圆弧形的刷毛可以保护牙龈,刷牙不出血。
现有技术检索结果
审查员检索到了两篇对比文件:

第三步:判断是否显而易见。 这里的关键是:本领域技术人员是否有动机将这两篇对比文件结合起来。
对比文件2明确教导了“磨毛可以保护牙龈”,而对比文件1已经公开了牙刷的基本结构。当本领域技术人员想要解决“刷牙时损伤牙龈”的问题时,他自然会想到去查阅关于牙刷改进的文献,从而发现对比文件2的教导。
因此,将对比文件1和对比文件2结合起来,对本领域技术人员来说是显而易见的。这件专利申请不具备创造性。
观点验证
这个案例很好地验证了我提出的观点:“用新的方案解决旧的问题,创造性小一些”。

但还发现了更有力的证据——对比文件4。这是一份新检索到的“竹木菜板”专利,它的背景技术部分明确提到:现有专利中已公开了竹菜板,竹子的弹性好、纤维多,制成菜板后不易裂缝,剁肉时产生的竹沫少。
对比文件4本身虽然关注的是抗菌问题,但它公开了一个重要信息:用竹子做菜板能够解决易裂缝及剁肉起碎屑的问题。
第二步:确定区别特征和实际解决的技术问题。
权利要求1与最接近的现有技术(竹菜板)的区别在于:
1. 形成竹排的长条竹片之间是通过胶粘合的;
2. 将多层竹板组合作为切菜板使用。
实际解决的技术问题是:使得菜板平整,用相应竹排来制造菜板。
第三步:判断是否显而易见。
对于区别特征1:将长条竹片通过胶粘合形成竹排,是竹制品加工领域的公知常识。
对于区别特征2:对比文件1公开了横拼竹地板,对比文件3公开了纵横交错的多层拼竹地板,这些结构都具有强度高、不变形等优点。本领域技术人员很容易想到将这些结构应用于菜板制造。
因此,这件专利申请不具备创造性。
观点验证
这个案例同样印证了我的观点。
“竹制切菜板”要解决的问题是“菜板变形、起屑”——这是一个已经存在的问题。对比文件4已经公开了“竹子可以做菜板,且能减少起屑”的信息。在此基础上,把竹地板领域的多层拼合结构应用到菜板上,本质上是用已知的结构去解决已知的问题,创造性自然有限。
四、什么是“发现新问题用新方案”?
结合以上的观点和上述案例,我们可以总结出创造性的层次:
第一层次(创造性最高):发现新问题,用新方案解决。
· 例如,发明人发现了前人从未意识到的技术问题,并创造性地提出了解决方案。这是开拓性发明,具备最高的创造性。
第二层次(创造性较高):发现新问题,用现有方案解决。
· 能够发现新问题本身就需要创造性思维。即使解决方案是现有技术,但这种“问题发现”本身就是创新。
第三层次(创造性较低):解决旧问题,用新方案解决。

五、思考题:什么会影响创造性判断?
在案例一的最后,留下了两个思考题,对我们理解创造性很有帮助:
问题1:如果申请人声称能解决“治疗世界上一切牙齿疾病”,会不会影响创造性判断?
不会。创造性判断应当基于发明的技术特征和实际能够实现的技术效果,而不是申请人夸大的声称。审查员只会考虑发明实际能够解决的技术问题。
问题2:如果申请人在说明书中指出刷头背面的凸块间隔1毫米、高度2-3毫米,能不能使权利要求1具备创造性?
可能可以。如果这些具体的参数带来了意想不到的技术效果(例如,特定的凸块尺寸和间隔能够更有效地刺激穴位),并且现有技术中没有公开这些参数,那么这种具体化改进可能具备创造性。
创造性是专利的“灵魂”。没有创造性的技术方案,即使申请了专利,也很可能在审查或无效宣告程序中被驳回。
通过这两个案例,我们可以看到:创造性判断不是简单的“新不新”的判断,而是“是否显而易见”的判断。一件发明创造,如果是在已有技术基础上的简单组合,或者用已有技术解决已有问题,往往难以获得专利授权。
